2. GENERAL

2.1
For any matters not regulated in these General Terms and Conditions (hereinafter: “GTC”) and for the interpretation of these GTC, the laws of Hungary shall apply, with particular reference to the relevant provisions of Act V of 2013 on the Civil Code, and Act CVIII of 2001 on Certain Issues of Electronic Commerce Services and Information Society Services.
The mandatory provisions of the applicable legislation shall apply to the parties without any specific stipulation.

2.2
All information and photographs published by the operator may only be used with the operator’s prior written request and subsequent approval.

2.3
The language of contracts falling under the scope of these GTC is Hungarian.
The applicable legislation is that in force in the territory of the Republic of Hungary and the applicable legislation of the European Union.

3. REGISTRATION

Natural persons and legal entities may register as customers on the website operated by the Provider at www.retrozeum.hu.
During registration, the user is required to fill in all fields marked as mandatory by the system.
If the Provider becomes aware that false information has been provided, the registered user may be excluded from the webshop and the Provider reserves the right to unilaterally cancel the order immediately.
The Provider assumes no responsibility for incorrectly completed data.

At the end of the registration process, users may choose to accept or decline subscription to the newsletter.
If the newsletter subscription is declined during registration, it may be activated at any time later via the “Profile / Edit Data” menu.
Users may unsubscribe from the newsletter at any time by clicking the “unsubscribe” link at the bottom of the received newsletter.

4. DATA PROTECTION

 

The Operator handles all acquired data confidentially and uses it solely for the purpose of fulfilling orders and other purchase-related activities.
Your data will not be disclosed to third parties, except to the delivery service provider during the performance of the contract.
The processing of your data is carried out in compliance with the provisions of Act LXIII of 1992 on the Protection of Personal Data,

in accordance with the Data Protection Act.

5. INFORMATION REGARDING PRODUCTS AND PRICES

5.1
The product prices include 0% VAT. The prices displayed in the webshop are the total (gross) prices to be paid.

5.2
All prices are quoted in Hungarian Forint (HUF).

5.3
Product prices do not include shipping costs.

5.4
All products are considered used items. Every item is second-hand, previously opened, or without original packaging.
Products found in their original manufacturer’s packaging are also regarded as used.
Due to their age, products may show minimal scratches, surface marks, or small imperfections.
We make every effort to provide a complete and accurate description of each item’s condition.

5.5
The Provider displays the product name, description, and photographs of the products in the webshop.
All images shown on the product pages accurately represent the actual items and are taken of the specific product offered for sale.
The Provider reserves the right to correct typographical errors or mistakes in descriptions, as well as to change prices without prior notice.

5.6
For products whose value and demand are determined by their original sealed packaging
(e.g., sports and other trading cards, unopened packs and boxes, Panini products, etc.),
we take every possible precaution to preserve the integrity of such packaging.
If the seal on these products is damaged to an extent that could allow misuse (such as resealing or repackaging),

please report this immediately upon receipt by sending us an email with photographs to retrozeum@gmail.com.

6. ORDERS

6.1 General

Products in the webshop can be purchased with or without registration.
We accept no responsibility for incorrectly provided data, including an incorrectly entered delivery address.
In such cases, the cost of resending the order shall be borne by the customer.

6.2 Order Process – Without Registration

You may add products to your shopping cart by clicking the “Add to cart” button, and then proceed by clicking the “Checkout” button.

Next, you will be required to enter your contact details, billing and/or shipping information.
At this stage, you may also subscribe to our newsletter, even without creating an account.

The next step is to select the shipping method, followed by the payment method.
(Available payment and shipping options are detailed later in Section 8.)

After this, you will see the order summary, where you can review all details before finalising your order.

Before finalising, you must accept the Terms & Conditions (T&C) and the Privacy Policy.
By accepting them – as clearly indicated – you enter into a legally binding purchase obligation.
Failure to fulfil this obligation entitles the Provider to lawfully enforce the payment.

The confirmation button is labelled “Confirm Order”.
The confirmation email will contain all details of your order, with the T&C and Privacy Policy attached.

6.3 Order Process – With Registration

Before or during the ordering process, you must log in with your registered account details.

Products can be added to the shopping cart by clicking the “Add to cart” button, and then proceeding with the “Checkout” button.

Registration can also be completed during checkout.
Therefore, even if you have multiple items in your cart, you can still register at that stage and proceed with your purchase.

The next step is to select the shipping method and the payment method.
(Available payment and shipping options are detailed later in Section 8.)

After this, you will see the order summary, where you can review all details before finalising your order.

7. ORDER PROCESSING AND FULFILLMENT

7.1 Order Processing
Orders are processed once payment for the product(s) has been received.
If the payment has not yet been received, the order will remain on hold until it arrives.

For cash-on-delivery orders, the product must be paid for directly to the courier upon delivery. In this case, we do not wait for payment before shipping; the order will be dispatched in advance.

7.2 Fulfillment
The general order fulfillment time is within 3–7 business days from order confirmation, but no later than 8 business days.

7.3 Product Unavailability

If the Seller is unable to fulfill the contract because the specified product is unavailable, the Seller is obliged to inform the Customer immediately and refund any amount already paid by the Customer without delay, but no later than within thirty (30) days.

7.4 Order Statuses
After receiving the order, the Customer will be informed via confirmation emails about the current status of their order. The three order statuses are:

  • Awaiting Processing – The order is being prepared; we are awaiting payment.

  • Awaiting Shipment (Paid) – Payment has been received; the order is being packaged and prepared for dispatch.

  • Shipped – Order Closed – The order has been handed over to the courier company.

Once the order has been handed over, the delivery time depends on the courier service.

Credit and debit card payments can be made securely via the Barion system. Online card payments are processed by Barion Payment Zrt., and your card details are never shared with the merchant.

9. SHIPPING METHODS AND DELIVERY

9.1 Shipping Methods
Orders are shipped via Magyar Posta (Hungarian Post), including EMS Express Mail both within and outside the European Union.
Shipments are dispatched on business days, usually within 2–3 days after the order is placed.
Shipping fees are calculated according to the current rates of Magyar Posta.

9.2 Personal Pickup
Orders may also be collected in person at our store during opening hours.

9.3 Failed Delivery
If delivery fails due to reasons attributable to the customer, the cost of reshipping will always be borne by the customer.

10. RIGHT OF WITHDRAWAL:

10.1 The Buyer may withdraw from the purchase (order) without any reason within 14 calendar days from the date of the purchase (order).
The Buyer must declare the exercise of the right of withdrawal clearly and in writing (by email or letter).
Withdrawal notifications sent by phone or SMS cannot be accepted.
The Buyer may exercise the right of withdrawal within the period between the contract conclusion date (order date) and the date of product receipt.

10.2
The date of receipt (i.e., product handover) in case of home delivery is the date when the product is received from the post office or courier.
Personal collection does not exclude the right of withdrawal, and the Buyer still has 14 calendar days to exercise this right.

10.3
In case of withdrawal, the Buyer is obliged to return the product at their own cost to the Service Provider at the address of the business premises provided in these Terms and Conditions.
The Buyer must prove the return of the product within 14 days.
The Service Provider will only refund the purchase price (or the amount paid by the Buyer as consideration) if the Buyer has returned the product(s) or has conclusively proven that the product(s) were sent back within 14 calendar days from the notification of withdrawal.

10.4
According to applicable laws, the Service Provider shall refund the purchase price of the returned product(s) and the shipping costs related to the order without delay, but no later than within 14 calendar days from the date the returned product(s) are received by the Service Provider.

10.5
The refund will be made using the same payment method used in the original transaction, unless the Buyer has expressly agreed to a different method.
No additional costs shall be charged to the Buyer for choosing a different refund method.

10.6
In case of withdrawal, the Service Provider may claim compensation from the Buyer for any damage or depreciation of the product resulting from improper use.

10.7
The right of withdrawal and related provisions are regulated by Government Decree No. 45/2014 (II.26.).

11. WARRANTY:

he Service Provider guarantees the authenticity of every item classified as antique, vintage, or numismatic, except when it is explicitly stated that the item is a reproduction.
The Buyer is obliged to report any complaint regarding the authenticity of the purchased item in writing to retrozeum@gmail.com within 14 days from the date they become aware of the justified doubt.

12. COMPLAINT HANDLING:

12.1 Contact information for complaints:
Customers may submit consumer complaints related to the product or the Service Provider’s activities at the following addresses:

12.2 General:
According to applicable laws, the Service Provider shall immediately investigate any verbal complaint (made in the store) and remedy it if the nature of the complaint allows.
If the Customer disagrees with the handling of the complaint or if an immediate investigation is not possible, the Service Provider shall promptly record the complaint and its position in a protocol, and provide a copy of this protocol to the Customer on site in case of a verbal complaint.

12.3
The Service Provider is obliged to examine and respond substantively to written complaints within thirty days of receipt, and to ensure that the response reaches the Customer.
If the complaint is rejected, the Service Provider must justify the rejection in the substantive reply.
The Service Provider is required to keep the complaint protocol and a copy of the reply for five years.

12.4
In case of rejection of the complaint, the Buyer may turn to the district authority.
In consumer disputes, both the Service Provider and the Buyer may use the conciliation body.

13. MISCELLANEOUS PROVISIONS:

Contract validity:
The contract is concluded online by conduct implying acceptance, either by clicking or through electronic correspondence.
Contracts formed through the use of the website are in Hungarian and are not considered written contracts, nor are they registered by the Service Provider.
The contractual relationship between the parties is governed by Hungarian law, primarily Act V of 2013 on the Civil Code, and Act CVIII of 2001 on electronic commerce services.

14. DISPUTES:

In case of disputes, the contracting parties submit to the exclusive jurisdiction of the Central District Court of Pest or the Budapest Metropolitan Court, depending on the amount in dispute.
The court shall act according to Hungarian law.

15. SPECIAL PROVISIONS FOR INTERNATIONAL SALES:

Special Provisions for International Sales

These General Terms and Conditions (GTC) are formulated based on the applicable Hungarian and European Union laws and primarily apply to sales within Hungary and the EU member states.

If the Buyer orders products from a third country outside the European Union, the laws of the destination country may also apply in addition to these GTC. This is especially relevant in the following areas:

  1. Consumer Protection and Right of Withdrawal
    For purchases from third countries, the Buyer's right of withdrawal, complaint handling procedures, and other consumer protection provisions may be regulated according to the laws of the destination country, which may differ from Hungarian or EU regulations.

  2. Taxation and Customs
    Taxes, customs duties, fees, and other import costs arising at the time of purchase and receipt of the goods are determined and payable according to the regulations of the destination country, for which the Buyer is responsible.

  3. Shipping Terms
    Delivery deadlines, costs, risk transfer, and return shipping costs may vary depending on the applicable rules and practices of the destination country.

  4. Warranty and Guarantee
    The warranty and guarantee rights relating to the products may be determined by the laws of the destination country, which may differ from those under Hungarian law.

  5. Complaint Handling and Legal Enforcement
    The Buyer may submit complaints to consumer protection authorities in the destination country, and the rules regarding dispute resolution and the competent authorities may differ from those applicable in Hungary.

  6. Data Protection
    In addition to Hungarian and EU data protection regulations, the data protection laws of the destination country may also apply to the processing of the Buyer's personal data.

  7. Applicable Law and Jurisdiction
    In the case of purchases from third countries, in addition to Hungarian law, the law of the destination country may apply to the contract and disputes, and the competent courts or authorities of the destination country may have jurisdiction.

It is the Buyer's responsibility to become acquainted with and comply with the laws and any customs and tax obligations of the destination country in advance.

As the Data Controller, by publishing this Privacy Statement and Data Management Information (hereinafter: Privacy Statement),
the Data Controller hereby discloses its principles regarding data processing,
which it acknowledges as binding upon itself.
The Data Controller undertakes all measures reasonably necessary to ensure the security of the personal data processed by it.

2. GENERAL:

The Data Controller has given special consideration to Regulation (EU) 2016/679 of the European Parliament and of the Council (General Data Protection Regulation, hereinafter GDPR),
as well as to the provisions of Act V of 2013 on the Civil Code (hereinafter: Civil Code).

Data processing is always based on the consent of the data subject.
By registering on the Webshop, placing an order either with or without registration, and subscribing to our newsletter,
you, as the User, consent to the Data Controller processing your personal data within the framework of this Privacy Statement,
in accordance with the applicable Hungarian and European laws,
and using it to the extent, in the manner, and for the duration set forth in this document.

3. DEFINITIONS:

The applicable legislation governing the processing of Users' personal data is Act CXII of 2011 on the Right of Informational Self-Determination and on Freedom of Information (hereinafter: Info Act).

The meanings of the terms used in this Privacy Statement correspond to those defined in Section 3 of Act CXII of 2011.

4. SCOPE OF USERS AND CONSENT:

 

Users are natural or legal persons who are either registered on the site or unregistered but use the services of the Webshop and place orders, identified based on their personal data.
If the user is registered, they also provide their consent to data processing (Consent Statement).

5. SCOPE OF PERSONAL DATA PROCESSED:

The personal data processed by the Data Controller include the following:
Name/Company name, Shipping address/Billing address/Tax number, email address, phone number, purchased product(s) and their specifications, date and time of purchase.

The Data Controller does not assume responsibility for the accuracy of the personal data provided.

The User bears sole responsibility for the accuracy of the personal data supplied.

6. NEWSLETTER:

We send newsletters only if the User has subscribed to the newsletter.

(Acceptance is indicated by checking the box labeled “I, Yes, subscribe.”)

Scope of processed data: Email address and the data listed in section 5.

Purpose of processing: Sending marketing electronic mails (emails) to inform Users about news, offers, and promotions.

Duration of data processing: The Data Controller processes the personal data of Users who voluntarily subscribe to the newsletter until the User withdraws their consent.

Withdrawal statement: Newsletter consent can be withdrawn at any time (Unsubscribe link available in each received newsletter). In this case, no further newsletters will be sent to the User.

7. PURPOSE AND LEGAL BASIS OF PERSONAL DATA PROCESSING:

Purposes of data processing:
The purpose of data processing is to enable the use of services provided by the Data Controller by the Users, and to enable the Data Controller to fulfill these services, including product sales and tracking, User identification, as well as to ensure that the User receives information regarding their order.

Legal basis and manner of data processing:
The recording and processing of personal data during registration on the Website, as well as through the use of services, is based on the voluntary consent of the User. This consent is given by the User when placing an order or completing registration on the Website.

The User acknowledges that the Data Controller may process the collected data to fulfill its legal obligations without further separate consent, even after the withdrawal of the User’s consent.

8. DATA CONTROLLER AND AUTHORIZED DATA PROCESSORS:

The person authorized to manage and process personal data is Rimóczy Kolos E.V.

Personal data to be processed may be accessed by the Data Controller’s lawful representative(s) and employees involved in data processing.

9. DURATION OF DATA PROCESSING:

Personal data provided based on the User’s consent shall be processed by the Data Controller until the purpose of data processing is fulfilled or until the User withdraws their consent.

The Data Controller shall process the personal data provided during User registration until the termination of the use of the Webshop (i.e., until the deletion of the registration).

Furthermore, the Data Controller shall retain and process the personal data provided by the User for accounting and tax purposes for a period of 8 years, in accordance with Section 169 of Act C of 2000 on Accounting, and within the limitation period defined by Act XCII of 2003 on Taxation

10. DATA TRANSFER AND DATA LINKAGE:

The Data Controller does not sell, lease, or otherwise provide personal data or information relating to the User to any third party, except for data provision required to fulfill accounting obligations to the National Tax and Customs Administration.

The Data Controller shall take all reasonable measures to ensure the appropriate security of the data and implement the necessary technical and organizational measures to enforce data protection rules and principles and to safeguard personal data.

By using the provided services and submitting the personal data necessary for such services as described above, the User consents to the transfer of their personal data by the Company to the delivery company responsible for shipping the products.

11. COOKIES:

Our website may use cookies to provide personalized service and convenience functions to the User.
When cookies are used, technical data is logged during the User’s visit to the Webshop.
The Data Controller does not link these data with any other personal information.

12. USERS’ RIGHTS REGARDING THE PROCESSING OF THEIR PERSONAL DATA:

Users have the right to request information from the Data Controller about the processing of their personal data.
Furthermore, Users may request the correction or deletion of their personal data.
Please note that deletion does not apply to data processing required by law (e.g., accounting regulations);
such data must be retained by the Data Controller for the legally prescribed period.

In case of any grievance related to the processing of personal data, the User may turn to the Hungarian National Authority for Data Protection and Freedom of Information (NAIH),
in accordance with Act CXII of 2011 on the right of informational self-determination and freedom of information.

13. COMPLIANCE WITH LEGAL REGULATIONS:

 

In the preparation of this Privacy Policy and in the processing of Users’ personal data,
the Data Controller shall act in full compliance with the applicable Hungarian and European laws in force at all times.

14. SPECIAL RULES FOR INTERNATIONAL SALES AND DATA PROCESSING IN CASE OF THIRD-COUNTRY PURCHASES

  1. Scope and Applicable Law
    In case of purchases made by buyers from third countries (outside the European Union), the applicable laws of the buyer’s country of residence as well as the laws of the destination country shall apply. This means that the buyer must comply with the consumer protection, customs, and tax regulations of their own country.

  2. Customs and Tax Obligations
    The third-country buyer is responsible for fulfilling customs procedures and other import-related obligations. The webshop operator does not take responsibility for the payment of customs duties, taxes, or any other fees required by the customs authorities of the destination country.

  3. Shipping and Delivery
    In international shipping cases, delays or customs procedures may occur that are beyond the webshop’s control. The terms of shipping and responsibility are governed by the contract between the buyer and the shipping company.

  4. Data Processing in Third Countries
    If personal data is transferred to third countries, the webshop operator ensures that data processing complies with the EU data protection regulations (GDPR) as well as the data protection laws of the destination country. The rights of data subjects and the security of the data are of utmost importance.

  5. User Rights and Complaint Handling
